Terms of Use — Sky Cashback POS

1. Introduction
These Terms of Use (the "Terms") govern access to and use of the Sky Cashback POS application (the "POS App"), operated by Sama for Investments, a company registered under the laws of the Syrian Arab Republic, with its head office in Damascus – Customs Square – Free Zone – Sky Building – Ground Floor (the "Company", "Sky Cashback", "we", "us").
The Company is licensed to carry out electronic marketing activity under commercial register no. 0311010423, and operates within the scope of that licence and the laws governing it. The Sky Cashback application is approved by the National Authority for Information Technology Services under final licence no. 31/2036 – dated July 7, 2026.
The POS App is used by stores that the Company has authorized as points of sale for its vouchers. By signing in to or using the POS App, the store and each of its operators agree to be bound by these Terms. If you do not agree to them, you must not use the POS App.
2. Definitions
- Point of sale (the "Store"): a store authorized by the Company to sell the Company's vouchers to registered Sky Cashback customers. The point of sale is a sales agent for the Company's vouchers.
- Operator: the Store's owner or a member of its staff whom the Store has authorized to use the POS App.
- Point-of-sale agreement: the separate agreement between the Company and the Store that sets out the terms of the Store's authorization.
- Voucher: a product the Company owns and sells, which is redeemed exclusively to obtain goods or services from partner merchants through the Sky Cashback app, and which cannot be refunded in cash or exchanged for cash of any kind.
- Customer: a person registered in the Sky Cashback customer app.
- Voucher card: the vouchers sold by the Store in a single sale, issued to one named customer and usable only by that customer.
- Total vouchers value: the total value of the vouchers the Store has bought and not yet sold, as shown in the POS App.
- Sell PIN: an optional code which, when switched on, must be entered to approve each sale.
3. Relationship with the Point-of-Sale Agreement
- These Terms govern the use of the POS App. They supplement the point-of-sale agreement and do not replace it.
- If these Terms conflict with the point-of-sale agreement, the point-of-sale agreement prevails.
- Prices of vouchers for points of sale, and any commission or discount granted to the Store, are set in the point-of-sale agreement only.
4. Nature of the Vouchers
- Every voucher is a product the Company owns and sells. It is goods, not money, not a deposit, not a financial instrument, and not electronic money or stored value.
- The Company is not a bank, a financial institution, a payment service provider, or an electronic wallet, and the POS App is not a financial technology (fintech) service, a payment service, or a money transfer service, and may not be used or presented as such.
- The total vouchers value shown in the POS App represents vouchers the Store has bought and may sell to customers. It is not a cash balance and not an account held for the Store with the Company.
6. Account and PIN Security
- Operators sign in with their mobile number and password. Keep the password confidential and do not share it.
- The Store may switch on the sell PIN, so that every sale must be approved with the PIN. Changing or recovering the sell PIN requires a verification code sent to the registered phone.
- Keep the sell PIN confidential and share it only with the staff the Store authorizes to sell.
- If you suspect that a password, the sell PIN, or a device with the POS App signed in has been compromised, notify us immediately at support@sky-cashback.com.
- The Company is not liable for losses resulting from unauthorized use of the account caused by the Store's failure to protect its credentials or devices.
7. Buying Vouchers
- The Store buys voucher denominations from the Company for its stock, in Syrian pounds, through the payment methods available in the POS App:
- Paymera (bank card payment in Paymera's secure page inside the App; card details are entered with Paymera and are not stored by the Company).
- MTN Cash or Syriatel Cash, using the paying phone number and a one-time code.
- Sham Cash, as a transfer request.
- A purchase made through a payment provider is also subject to that provider's terms. The availability of any payment method depends on the relevant provider and may change without prior notice.
- Vouchers bought through Sham Cash are added to the Store's total vouchers value only after the Company approves the request.
- Once bought, vouchers are non-refundable and cannot be exchanged for cash. They can only be sold to customers through the POS App in accordance with these Terms.
8. Selling Vouchers
- Vouchers may be sold only through the POS App, and only to a registered Sky Cashback customer.
- To sell, the operator identifies the customer by entering their mobile number or scanning the "Receive" QR code shown in the customer's app, chooses the denominations, and confirms the sale.
- Before confirming, the operator must verify that the customer shown in the App is the person being served.
- The voucher card is issued to that customer only, and only that customer can use it. The customer's phone number is never shown on the card.
- The value of the vouchers sold is deducted from the Store's total vouchers value.
- The operator may share the voucher card with the customer or save its image to the device's photo library; the image is saved only when the operator chooses to.
- The Store must not resell vouchers outside the App, and must not misrepresent what a voucher is. In particular, the Store must not describe a voucher as money, a deposit, or a means of transferring or withdrawing money.
- The Store must not charge customers any price or fee other than the one permitted by the point-of-sale agreement.
9. Mistakes and Voids
- A sale cannot be reversed from within the POS App.
- If a sale is made in error, contact the Company promptly at support@sky-cashback.com.
- The Company may void a voucher card that has not been used. Any voided card is handled in accordance with the point-of-sale agreement.
- The Company is not obliged to void a card that has already been used, in whole or in part.
10. Customer Data Confidentiality
- Customers' mobile numbers, names, and other information that the Store receives through the POS App are confidential.
- That information may be used only to issue the voucher card being sold. It must not be copied, kept, shared, or used for marketing or any other purpose.
- The Store must ensure that its staff comply with this section, including after they stop working for the Store.
11. Prohibited Conduct
- Any unlawful, fraudulent, or deceptive activity, including fictitious sales.
- Using the POS App or the vouchers for money transfer, cash-out, or any service that exchanges vouchers for cash.
- Selling vouchers to anyone other than the registered customer the card is issued to, or on behalf of anyone other than the Store.
- Sharing, selling, or lending the Store's account or sell PIN to anyone who is not authorized staff.
- Manipulating transaction records or reports.
- Reverse engineering, decompiling, or attempting to extract the source code of the POS App, or interfering with its security, infrastructure, or proper operation.
The Company reserves the right to suspend or terminate any account engaged in prohibited conduct without prior notice, and to notify the competent authorities where appropriate.
12. Intellectual Property
- The POS App, including its design, logos, trademarks, text, graphics, and software, is the exclusive property of Sama for Investments or its licensors.
- The Store is granted a limited, non-exclusive, non-transferable licence to use the POS App solely to buy and sell the Company's vouchers in accordance with these Terms and the point-of-sale agreement.
- No part of the POS App may be copied, reproduced, distributed, or used without the Company's prior written consent.
13. Availability and Changes to the App
- The Company may update, change, suspend, or discontinue any feature of the POS App at any time.
- Payment methods, voucher denominations, and features may be added, changed, or withdrawn without prior notice.
- The Company may carry out maintenance that makes the POS App temporarily unavailable.
14. Limitation of Liability
- The POS App is provided "as is" and "as available". The Company does not warrant continuous, error-free, or secure access to the POS App at all times.
- The Company is not liable for any indirect, incidental, consequential, or punitive damages arising from the use of the POS App.
- The Company is not liable for delays or failures caused by payment providers, telecom networks, or the Store's devices or internet connection.
- The Company is not liable for losses resulting from sales made to the wrong customer, or from unauthorized access to the Store's account caused by the Store's failure to protect its credentials.
15. Suspension and Termination
- The Company may suspend or terminate the Store's account at its absolute discretion if the Store or any of its operators breaches these Terms or the point-of-sale agreement, or engages in any prohibited conduct.
- The account is closed when the Store's authorization as a point of sale ends.
- The Store may request closure of its account by contacting support@sky-cashback.com. Accounts cannot be deleted from within the App.
- On termination, any vouchers the Store holds are dealt with in accordance with the point-of-sale agreement and applicable law. Vouchers cannot be exchanged for cash and their value is not refunded in cash.
- Voucher cards already sold to customers remain valid for those customers.
16. Privacy
- The collection and use of personal information through the POS App is described in the Sky Cashback POS Privacy Policy: https://sky-cashback.com/en/pos/privacy
17. Modification of Terms
- The Company reserves the right to amend these Terms at any time.
- Stores will be notified of material changes through the App or through registered communication channels.
- Continued use of the POS App after amendments constitutes acceptance of the updated Terms.
18. Governing Law and Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of the Syrian Arab Republic.
- Any disputes arising out of or relating to these Terms are subject to the exclusive jurisdiction of the competent courts in Damascus, Syria.
